THE WHAT? L’Oréal, Coty & Revlon have lost a lawsuit against Israeli company Oil De Lamor for allegedly selling perfumes resembling their scent and name brands.
THE DETAILS The lawsuit, initiated six years ago, accused Oil De Lamor of emulating their fragrances and using their product names. While these companies don’t have patents on fragrance compositions, they hold registered trademarks for their brand names in Israel.
THE WHY? Judge Gershon Gontovnik ruled that under Israeli law, while direct use of registered trademarks is prohibited, referencing protected to sell similar products is allowed if there’s no confusion caused to consumers. The international brands can appeal the decision to the Supreme Court if they choose to do so.
